Terms of Service

These terms of service govern your use of ClearBid, operated by Gavin Andrews, doing business as ClearBid ("ClearBid," "we," "us," or "our"). By accessing or using the site, you agree to be bound by these terms. If you do not agree, do not use it.

1. AI Disclosure

You are interacting with an artificial intelligence system, not a human professional. Every report, flag, question, and recommendation ClearBid produces is generated by a large language model (currently Anthropic's Claude) based on the information you provide. No human reviews, verifies, or approves any individual report before it is shown to you. AI-generated output can be wrong, incomplete, or misleading in ways that are not obvious — treat it as a starting point for your own judgment and due diligence, not a final answer.

2. What ClearBid is

ClearBid is a tool that uses artificial intelligence to help contractors review draft estimates for completeness and risk, and to help homeowners and property managers compare bids they've received. ClearBid generates its output using a third-party AI model based on the information you provide.

3. What ClearBid is not

ClearBid is not a licensed contractor, estimator, engineer, inspector, appraiser, financial advisor, or attorney, and nothing the service produces is a substitute for advice from one. The service does not perform a physical inspection of any property or project. On the contractor side, the service never states, implies, or suggests a specific dollar amount — it identifies categories of scope, risk, or documentation that may be missing or underspecified, and the pricing decision always remains yours.

Reports are generated by an AI model and may be incomplete, inaccurate, or fail to identify issues that a licensed professional would catch. You are solely responsible for verifying any information before relying on it for a contract, bid, purchase, or other decision.

4. Who can use ClearBid

You must be at least 18 years old and, if using the service on behalf of a business, have the authority to bind that business to these terms.

5. Your account

You can use the service without an account. If you create one, you are responsible for the accuracy of the information you provide, for keeping your password confidential, and for everything done through your account. Do not share your credentials. Tell us promptly at info@useclearbid.com if you believe your account has been accessed without your permission.

One account per person or business. Do not create an account using someone else's email address, impersonate another person or business, or use automated means to register accounts. We may suspend or remove an account we reasonably believe violates these terms.

We ask you to confirm your email address after signing up. Until you do, your account works for free reviews but cannot hold a paid plan. Password reset and confirmation links are single-use and expire; resetting your password signs out every device, including any you didn't recognize. Keep your address current — it is the only way we can return access to you if you lose your password.

You may delete your account at any time from your account page. Deletion is immediate and permanent: your email, password hash, plan selection, sign-in sessions, and review history are removed and cannot be restored. See our Privacy Policy for exactly what an account stores.

6. Plans, pricing, and free reviews

ClearBid currently offers a free ClearBid Lite review: an abbreviated summary of the full report. Lite is intentionally partial — it indicates whether issues were found without explaining each one — and is subject to the same disclaimers, warranty exclusions, and liability limits as any other output of the service. Do not treat a Lite summary as a complete review of a bid or estimate.

Paid plans are described on the site at their stated prices in US dollars. Prices do not include any sales or value-added tax that may apply where you are; where such tax applies it is added at checkout. We may change prices or what a plan includes at any time, but a change never affects a purchase you have already made, and a subscription price change takes effect only from your next renewal after we tell you.

Payments are handled by Stripe. You enter your card details on Stripe's own page, not on ClearBid, and we never receive or store your full card number. By paying you also accept Stripe's terms for that transaction.

7. What each plan gives you

A single review entitles you to one full report, which you may run at any time within 90 days of purchase. It is used once a report is produced from it, whether or not you find that report useful, and it lapses if those 90 days pass without being used. We will email you a reminder before it lapses, but the responsibility to use it in time is yours.

The monthly subscription entitles you to unlimited full reports while it is active. It renews automatically each month at the then-current price, charged to your saved payment method, until you cancel.

Free ClearBid Lite summaries remain available whether or not you hold a plan.

8. Cancelling, renewals, and failed payments

You may cancel a subscription at any time from your account page. Cancelling stops the next renewal; it does not end your access immediately. You keep full access until the end of the period you have already paid for, and you are not charged again after that. You may restart a cancelled subscription before that date and it will simply continue.

If a renewal payment fails, Stripe may retry it. If it continues to fail, your subscription ends and your reviews revert to free ClearBid Lite summaries. We do not pursue you for an unpaid renewal — the plan simply stops.

A single review cannot be cancelled once purchased, because it is a one-time purchase rather than a recurring one. See refunds below.

9. Refunds

If you have not used what you bought, we will refund it. That means a single review on which no report has been produced, or a subscription under which no full report has been generated during the current period. Write to info@useclearbid.com from the address on your account within 30 days of the charge and we will refund it in full.

Once a full report has been produced, that report has been delivered and is not refundable simply because you disagree with it or did not find it useful. The report is generated by AI and may be wrong or incomplete — that is disclosed before you buy, throughout the service, and in these terms, and you accept it as a known limitation of what you are purchasing rather than a defect.

None of this limits any refund or cancellation right you have under the consumer law of the place you live, where that law gives you more than this section does.

If you believe you have been charged in error, or charged twice, contact us before disputing the charge with your bank. We would rather fix it directly, and we will.

If you upgrade from an unused single review to a subscription, the amount you paid for that review is credited against your first month, and the single review is then used up.

10. Content you submit

You may submit text, images and PDF files describing a project, bid or estimate. You keep ownership of everything you submit. You grant us only the limited permission needed to transmit it to our AI processing provider and return a report to you — nothing more. We do not use your content to train models, we do not sell it, we do not share it with other users, and we do not keep it after your report is produced.

You confirm that you have the right to submit what you upload, and that doing so breaks no confidentiality agreement and infringes nobody's rights. A contractor's estimate is frequently marked confidential; if yours is, it is your responsibility to know whether you may share it before you do.

Do not submit:

  • Another person's sensitive personal information — government ID numbers, financial account numbers, or medical information — unless it is strictly necessary and you have the right to.
  • Content you do not have permission to share, including documents covered by a confidentiality or non-disclosure agreement.
  • Malicious files, or files whose contents differ from what they claim to be.
  • Anything unlawful, or anything intended to abuse, harass or defame another person or business.

We do not review what you submit before it is processed, and we have no obligation to monitor it. We may refuse or stop processing anything we reasonably believe breaks these terms, and may suspend an account that does so repeatedly. Because we do not retain your submissions, removing content after the fact is generally neither possible nor necessary — it is already gone.

If you leave feedback through the service, you allow us to read it and act on it to improve ClearBid. We will not publish it, or attribute anything to you, without asking you first.

11. Your data and your rights over it

What we hold about you, and for how long, is set out in full in our Privacy Policy, which forms part of these terms. In summary: we keep your account details and a list of which reviews you have run. We do not keep your bids, estimates, uploads, or the reports themselves.

You can see everything we hold on your account page, and delete all of it at any time from that same page. Deletion is immediate and permanent. If you would rather we did it, or you want a copy of your data first, write to info@useclearbid.com from the address on the account and we will do it within 30 days.

Depending on where you live you may have further rights over your personal information — to access it, correct it, delete it, or object to how it is handled. We will honour any such right you actually have, and we will not charge you for asking or treat you differently for having asked.

Payments are processed by Stripe, who necessarily receive your billing details and are a separate controller of that information. Their records of a transaction outlive your ClearBid account, because tax and anti-fraud law requires them to be kept.

12. No warranty

THE SERVICE AND ANY OUTPUT IT PRODUCES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY REPORT WILL BE ACCURATE OR COMPLETE.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CLEARBID AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITY, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE OR RELIANCE ON ANY REPORT IT PRODUCES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. TO THE EXTENT ANY LIABILITY IS NOT VALIDLY DISCLAIMED, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID CLEARBID IN THE 12 MONTHS BEFORE THE CLAIM, OR (B) $50.

14. Reports are final once generated

When a review finishes, that review is complete. You can't return to the form and re-run it against changed details — starting another review means starting a new one. If you bought a single review, that one is used, and another review requires another purchase. This applies the same way on every plan.

If you provide a project location, ClearBid uses it to make its questions and flags more relevant to where the work is happening. It does not give you the code, permit requirements, or fees for your jurisdiction, and anything it raises about local requirements is a prompt to confirm with your local building authority, not a statement of what the rule is.

15. Your responsibility

  • Verify anything the service flags — or doesn't flag — with a licensed professional before making a contractual, financial, or safety-related decision.
  • Confirm permit, code, and legal requirements with the relevant local authority; the service does not have jurisdiction-specific knowledge.
  • Use your own judgment. ClearBid is a second set of eyes, not a replacement for professional judgment or due diligence.

16. Indemnification

You agree to indemnify and hold harmless ClearBid and its operators from any claim, loss, or expense (including reasonable attorneys' fees) arising from your use of the service, the content you submit, or your reliance on any report it produces.

17. Changes and termination

We may modify, suspend, or discontinue the service, or update these terms, at any time. If we make a material change to these terms, we'll post the revised version here with a new date, and continuing to use the service after that date means you accept it. If you don't agree to a change, stop using the service — you can delete your account and everything in it at any time from your account page.

We may suspend or terminate your access if we believe you've violated these terms.

18. Governing law and where disputes are heard

These terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Any dispute arising out of or relating to these terms or the service will be brought exclusively in the state or federal courts located in Ventura County, California, and you consent to the personal jurisdiction of those courts.

19. If part of these terms doesn't hold

If any provision of these terms is found unenforceable, it will be limited or removed to the smallest extent necessary and everything else stays in force. These terms and the Privacy Policy are the whole agreement between you and ClearBid about the service, and replace anything said or written before them. If we don't enforce a provision on some occasion, that isn't us giving it up.
